1.1 Introduction

Welcome to AdsGency AI, the all-in-one advertising platform. These terms outline the agreement between users and AdsGency AI, encompassing our website, software application, and services herein referred to as 'AdsGency AI.'

1.2 Agreement to Terms

By creating an account, you agree to abide by these terms. Should you disagree, refrain from using the AdsGency AI image generation or posting service or downloading the software application. In case of an existing account, deletion is required. AdsGency AI reserves the right to update the TOS at any time without notice to you. The most current version of the TOS can be reviewed by clicking on the 'Terms of Service' hypertext link located at the bottom of our Web pages.

2. Accounts and Services

2.1 Account Creation and Eligibility

An account is mandatory for accessing AdsGency AI services. Users must be 18 years or older and capable of entering a legal contract. Account sharing is prohibited, and safeguarding account information is the user's responsibility. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities.

You agree to not use the Services to: upload or distribute any computer viruses, worms, or any software intended to damage or alter a computer system or data; send unsolicited or unauthorized advertising, promotional materials, junk mail, or any other form of duplicative or unsolicited messages; defame, harass, abuse, threaten or defraud Users of the Services, or collect, or attempt to collect, personal information about Users or third parties without their consent.

3. Purchases and Subscriptions

3.1 Subscription Services

Purchases or subscriptions grant users access to premium features. Although the availability of these features entirely depends on the pricing plan that the user decides to purchase, only after upgrading to a premium plan will all services be available to the user.

3.2 Usage and Refunds

Payments are non-refundable. Termination of a subscription stops its renewal, but access to Membership Services remains active until expiry.

3.3 Currency and Taxes

All amounts are denominated in US Dollars and may exclude applicable taxes like sales taxes.

3.4 Renewal and Access Termination

Failure to pay for a subscription may result in termination of access to Membership Services across plans.

4. Content Generation

4.1 Ownership and Usage

All content included as part of the Services, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Services, is the property of AdsGency AI or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.

Content generation for illegal purposes or accessing services via unauthorized means is strictly prohibited.

We do not make any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, or title concerning the AdsGency AI platform, to the fullest extent permissible under applicable law.
